By engaging Nexades for any service, you acknowledge that you have read, understood, and agreed to this Cancellation Policy.

Every client is encouraged to review this policy carefully before confirming any project.

Project Confirmation

A project is considered confirmed once both parties have agreed upon the project scope, pricing, payment schedule, and commencement date. Confirmation may occur through a written agreement, email communication, invoice acceptance, or payment of the required advance amount.

Once a project has been confirmed, Nexades immediately begins allocating resources, scheduling work, conducting research, and preparing for project execution.

Cancellation Before Project Commencement

Clients may request cancellation before any project work has officially begun.

If no research, consultation, planning, design, development, campaign preparation, or other billable work has been performed, Nexades may approve the cancellation at its sole discretion.

Administrative charges or payment processing fees may still apply where applicable.

Cancellation After Project Commencement

Once project work has commenced, cancellation requests become significantly more complex due to the professional time and resources already invested.

Project commencement may include, but is not limited to:

• Discovery meetings
• Consultation sessions
• Business analysis
• Market research
• Competitor analysis
• Strategy development
• Wireframing
• Design preparation
• Website development
• Campaign planning
• Technical implementation
• Creative production
• Testing
• Quality assurance
• Internal project management

Because these activities require professional expertise and dedicated resources, payments already made generally become non-refundable after work has begun.

Client Delays

Projects depend upon timely cooperation from clients.

Delays caused by late responses, missing content, incomplete information, delayed approvals, or failure to provide required materials may affect project schedules.

If a project remains inactive due to client inaction for an extended period, Nexades reserves the right to pause, reschedule, or close the project after providing reasonable notice.

Any future resumption of work may require revised timelines, additional costs, or a new project agreement.

Scope Changes

Requests that substantially change the agreed project scope are not considered cancellations.

Such requests may require:

• Revised pricing
• Additional timelines
• Updated project specifications
• New quotations
• Separate agreements

Nexades will communicate any required adjustments before continuing work.

Third-Party Services

Many projects involve third-party services such as hosting providers, domain registrars, payment gateways, advertising platforms, plugins, software licenses, APIs, stock assets, or external subscriptions.

Payments made to these third-party providers are governed by their respective policies and are generally non-refundable.

Nexades cannot recover or refund charges imposed by independent service providers.

Advertising Campaigns

For Meta Advertising projects, campaign budgets paid directly to Meta or any advertising platform are entirely separate from Nexades' professional service fees.

Advertising spend remains the responsibility of the client and cannot be cancelled or refunded through Nexades.

Platform-specific policies determine the treatment of advertising expenditures.

Completed Deliverables

Any completed work delivered before cancellation remains chargeable.

Examples include:

• Website designs
• Landing pages
• Campaign structures
• Creative assets
• Reports
• Technical configurations
• Development milestones
• Documentation

Ownership and delivery rights remain subject to the applicable service agreement and payment status.

Communication During Cancellation

Clients requesting cancellation are encouraged to contact Nexades directly before initiating disputes, chargebacks, or payment claims.

Our team will make reasonable efforts to understand the circumstances and seek a fair resolution whenever possible.

Professional communication frequently resolves concerns more effectively than formal disputes.

Chargebacks

Initiating fraudulent or unjustified payment disputes after services have been delivered may constitute a breach of these Terms.

Nexades reserves the right to suspend ongoing services, retain project records, provide supporting documentation to payment processors, and pursue appropriate legal remedies where permitted by applicable law.

Force Majeure

Neither party shall be held responsible for delays or inability to continue a project resulting from circumstances beyond reasonable control.

Such circumstances may include:

• Natural disasters
• Internet outages
• Government restrictions
• Cybersecurity incidents
• Public emergencies
• Labor disputes
• Power failures
• Infrastructure failures
• Other force majeure events

Where practical, both parties will cooperate to determine an appropriate course of action.

Future Engagements

Cancellation of one project does not automatically prevent future collaboration.

Nexades reserves the right to determine whether future engagements will be accepted based upon previous project history, communication, payment records, and overall business relationship.

Policy Updates

Nexades reserves the right to amend this Cancellation Policy at any time to reflect operational improvements, legal developments, or changes in business practices.

Any revised version becomes effective immediately upon publication unless otherwise stated.

Continued use of our website or services constitutes acceptance of the updated policy.

Governing Law

This Cancellation Policy shall be governed by and interpreted in accordance with the laws of India.
